§ 1 Scope

These Terms and Conditions apply to all orders placed by consumers and business customers through our online shop mollymotors.de with Molly Motor's e.K., Axel Tornau, Birkenstraße 75, 23758 Gremersdorf, Germany (“we”). A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade or profession.

§ 2 Formation of contract

The presentation of products in the online shop does not constitute a legally binding offer but a non-binding online catalogue. By clicking the order button, you place a binding order for the goods in the shopping cart. Confirmation of receipt of your order, along with acceptance of the order, is sent by automated email immediately after submission. The contract is concluded with this email confirmation.

§ 3 Prices and shipping costs

The prices listed on the product pages include statutory VAT and other price components. Shipping costs may apply in addition to the stated prices. Any applicable shipping costs will be clearly communicated during the checkout process before order submission.

§ 4 Delivery

Delivery is made to the delivery address you provide. The expected delivery time is indicated on the product page or during checkout. If, despite proper sourcing, the goods are not available, we are entitled to withdraw from the contract. In this case we will inform you immediately and refund any payments already made.

§ 5 Payment

Payment is made by PayPal, credit card, Klarna or other payment methods offered in the shop. Payment is processed via Shopify Payments and the respective providers of the selected payment method.

§ 6 Retention of title

The goods remain our property until full payment has been received.

§ 7 Right of withdrawal

Consumers have a statutory right of withdrawal. Detailed information and the model withdrawal form are available at Right of Withdrawal.

§ 8 Warranty

The statutory rights regarding defects apply. For used goods, the limitation period for warranty claims against consumers is reduced to one year from delivery. Warranty is excluded for used goods sold to business customers. The condition of the goods is described in detail in the respective product description.

§ 9 Liability

We are liable without limitation for damages resulting from injury to life, body or health based on negligent or intentional breach of duty. For other damages, we are only liable insofar as they are based on intent or gross negligence or on a culpable breach of material contractual obligations (cardinal duties). In these cases, liability is limited to the foreseeable damage typical for the contract. Any further liability is excluded.

§ 10 Dispute resolution

The European Commission provides a platform for online dispute resolution (ODR) available at ec.europa.eu/consumers/odr. We are willing, but not obliged, to participate in dispute resolution proceedings before a consumer arbitration board.

§ 11 Applicable law and jurisdiction

The law of the Federal Republic of Germany applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods. If the customer is a merchant, a legal entity under public law or a special fund under public law, our registered office is the exclusive place of jurisdiction for all disputes arising from this contract.

§ 12 Final provisions

Should individual provisions of this contract be or become ineffective, the effectiveness of the remaining provisions shall not be affected.
